1. Overview

Welcome to SEVENCELL DEVICES.

These Terms of Service (“Terms”) govern your access to and use of our website, online store, products, content, features, tools and related services collectively referred to as the “Services”.

In these Terms, “SEVENCELL DEVICES”, “we”, “us” and “our” refer to SHBKT ALJWAL MOBILE PHONES & ACCESSORIES TRADING L.L.C, trading as SEVENCELL DEVICES, Dubai, United Arab Emirates.

Our online store is hosted on Shopify, which provides the ecommerce platform that enables us to offer products and Services to you.

By accessing our website, creating an account, submitting an order or otherwise using the Services, you agree to be bound by these Terms and the policies incorporated into them, including our:

If you do not agree with these Terms, you must not use the Services or submit an order.

Nothing in these Terms excludes, restricts or reduces any consumer right or legal remedy that cannot lawfully be excluded under the applicable laws of the United Arab Emirates.

2. Legal Capacity and Eligibility

By using the Services or placing an order, you confirm that:

  • You have the legal capacity to enter into a binding agreement under applicable law;
  • The information you provide is accurate, current and complete;
  • You are authorised to use the selected payment method; and
  • You will use the Services only for lawful purposes.

If you are placing an order on behalf of a company or other legal entity, you confirm that you have authority to bind that entity to these Terms.

A parent or legal guardian is responsible for any purchase or use of the Services made by a minor under their supervision or through a device or payment method controlled by them.

3. Customer Accounts

You may be required to create an account or provide contact, billing, payment and delivery information to use certain Services.

You are responsible for:

  • Keeping your account details and password secure;
  • Restricting unauthorised access to your account and devices;
  • Ensuring your contact and delivery details remain accurate; and
  • Notifying us promptly if you suspect unauthorised account activity.

You must not sell, transfer, assign or allow another person to misuse your customer account.

We may suspend or close an account where we reasonably suspect fraud, misuse, unlawful activity, unauthorised access or a material breach of these Terms.

4. Our Products

We sell products that may include:

  • New mobile phones and electronics;
  • Refurbished mobile phones and electronics;
  • Pre-owned or used devices;
  • Accessories and related products; and
  • Other products displayed on our website from time to time.

The condition, specifications, included accessories, warranty period and other important information for each product will be shown on its product page, order confirmation, invoice or applicable written quotation.

Please review the complete product description before placing an order.

5. Refurbished and Pre-Owned Devices

Refurbished and pre-owned devices have previously been owned, used, returned, inspected, repaired, restored, tested or prepared for resale.

Such products may show signs of previous use according to the condition grade advertised on the relevant product page. These signs may include minor scratches, marks, wear or other cosmetic variations consistent with the stated grade.

Unless expressly stated otherwise:

  • A refurbished or pre-owned product should not be assumed to be brand new;
  • A product should not be assumed to have been refurbished or certified by its original manufacturer;
  • Packaging may be original, replacement or generic;
  • Included accessories may be original or compatible accessories;
  • Component and repair history may vary between individual devices;
  • Device colour, appearance and cosmetic details may vary slightly from website photographs; and
  • Minor cosmetic differences consistent with the advertised grade are not considered defects.

Where known and commercially relevant, material information concerning replacement components, functionality, compatibility, battery condition or other significant product characteristics will be disclosed on the product page or in the applicable sales documentation.

A product that is defective, unsafe, materially misdescribed, incomplete or materially different from the product ordered will be handled in accordance with our Return & Refund Policy, Warranty Policy and applicable law.

6. Device Condition Grades

Condition grades describe the expected cosmetic condition of refurbished or pre-owned products. Exact grading criteria may be displayed on our website or on the relevant product page.

Because each pre-owned device is unique, photographs may be representative unless the product page expressly states that photographs show the exact device being sold.

Condition grades generally relate to cosmetic appearance and do not replace the functional testing, warranty information or technical specifications stated for the product.

7. Battery Condition

Rechargeable batteries are consumable components that naturally reduce in capacity through age, usage and charging cycles.

Battery health, maximum capacity and battery performance may vary between refurbished or pre-owned devices.

Where a minimum battery-health percentage or particular battery condition is guaranteed, it will be stated on the product page, invoice or applicable written offer.

Unless a specific percentage is expressly guaranteed, customers should not assume that a pre-owned device battery will display the same maximum capacity as a brand-new device.

Normal battery degradation that is consistent with the disclosed product condition is not automatically considered a product defect. This does not affect any applicable right where the battery condition is materially different from what was expressly advertised.

8. Product Images, Colours and Displays

We make reasonable efforts to display products, colours and product conditions accurately.

However, the appearance of a product may vary depending on:

  • Your screen, browser or device settings;
  • Lighting and photography;
  • Minor manufacturing variations;
  • The individual cosmetic condition of a pre-owned device; or
  • Whether representative product photography is used.

Minor visual differences that do not materially affect the advertised specifications, condition grade or functionality will not by themselves make a product defective or incorrectly supplied.

9. Product Availability and Purchase Limits

All products are subject to availability.

Adding a product to your cart does not reserve the product or guarantee availability.

We may:

  • Limit the quantity available to any customer or delivery address;
  • Discontinue or withdraw a product;
  • Correct stock or availability information;
  • Limit sales in particular locations; or
  • Reject orders that appear to involve fraud, abuse, unauthorised resale or pricing exploitation.

Where a prepaid product becomes unavailable after an order is placed, we will offer an appropriate alternative where agreed or refund the amount paid for the unavailable product.

10. Orders and Contract Formation

Submitting an order constitutes an offer to purchase the selected products under these Terms.

An automated order acknowledgement confirms only that we have received your order. It does not necessarily mean that your order has been finally accepted.

An order is accepted when we confirm acceptance, approve the payment and begin processing or fulfilling the order.

We may request additional information or verification before accepting or dispatching an order.

Please review your order carefully before submitting it, including:

  • Product model;
  • Condition grade;
  • Colour;
  • Storage capacity;
  • Quantity;
  • Delivery address;
  • Contact information; and
  • Payment method.

We are not required to accept an order solely because it was submitted or because an automated acknowledgement was issued.

11. Right to Refuse or Cancel Orders

We may refuse, hold, limit or cancel an order where reasonably necessary, including where:

  • A product is unavailable;
  • A material pricing, stock, technical or product-description error occurred;
  • Payment is declined, reversed or cannot be verified;
  • Customer identity or payment verification cannot be completed;
  • The delivery information is incomplete, incorrect or unsupported;
  • We reasonably suspect fraud, unlawful activity or unauthorised use;
  • The order appears intended to circumvent purchase limits;
  • The order cannot reasonably be fulfilled; or
  • Accepting the order would breach applicable law or a contractual restriction.

If we cancel a prepaid order, we will refund the amount received for the cancelled product using the original payment method where reasonably possible.

12. Customer Order Cancellations

You may request cancellation before an order has been packed, fulfilled or handed to the delivery provider.

A cancellation request is not confirmed until we provide written confirmation that the cancellation has been accepted.

Once an order has been processed or dispatched, cancellation may no longer be possible. The order may instead need to be handled as a return after delivery under our Return & Refund Policy.

Payment-provider, delivery or administrative charges that cannot be recovered by us may be handled in accordance with the published Return & Refund Policy and applicable law.

13. Retail and Wholesale Orders

Our website may be used by both retail customers and approved business customers.

Retail consumer orders are governed by these Terms and any mandatory consumer-protection rights that apply to them.

Wholesale, reseller, bulk-quantity, export, trade or specially negotiated orders may be subject to additional or separate terms contained in:

  • A written quotation;
  • A proforma invoice;
  • A commercial invoice;
  • A purchase agreement;
  • A wholesale account agreement; or
  • Other written communications accepted by both parties.

Where separate written B2B terms conflict with these Terms, the separately agreed B2B terms will apply to the relevant commercial transaction to the extent legally permitted.

Voluntary consumer change-of-mind rights do not automatically apply to wholesale, reseller, export or other B2B transactions unless expressly stated in the applicable written agreement.

14. Prices and Taxes

Product prices, discounts and promotions may change without notice before an order is accepted.

The applicable price will be shown during checkout and recorded in your order confirmation, subject to the correction of clear or material errors.

Any applicable VAT, shipping fee, delivery charge or other mandatory charge will be displayed or communicated as required before the order is completed.

International customers may be responsible for customs duties, import taxes, clearance fees and other destination-country charges unless we expressly confirm otherwise in writing.

Prices offered through our website may differ from prices offered through:

  • Wholesale quotations;
  • Physical sales channels;
  • Social-media promotions;
  • Third-party marketplaces; or
  • Separately negotiated commercial transactions.

15. Pricing and Listing Errors

We may correct typographical, technical, pricing, stock, specification or product-description errors at any time.

If a material error affects an order that has already been submitted, we may:

  • Contact you for instructions;
  • Offer to continue the order using the corrected information;
  • Offer an alternative product; or
  • Cancel and refund the affected part of the order.

We will not knowingly rely on an error to mislead a customer or avoid any mandatory legal obligation.

16. Payment

Available payment methods will be displayed during checkout or communicated through the applicable sales channel.

You confirm that:

  • You are authorised to use the payment method provided;
  • The payment information is accurate;
  • Sufficient funds or credit are available; and
  • You authorise the applicable payment amount to be charged.

Payment may be processed by independent payment providers. Their terms, security checks and processing procedures may also apply.

We may delay fulfilment until payment is successfully authorised, received and verified.

For Cash on Delivery orders, additional verification, delivery restrictions, limits or confirmation procedures may apply.

17. Fraud and Identity Verification

To protect customers and our business, we may use reasonable fraud-prevention and order-verification measures.

We may request information reasonably necessary to verify:

  • The customer’s identity;
  • The billing or delivery address;
  • Payment authorisation;
  • Business-account information; or
  • The legitimacy of a high-value or unusual order.

We will process verification information in accordance with our Privacy Policy.

Failure to complete a reasonable verification request may result in delayed fulfilment or order cancellation.

18. Shipping and Delivery

Order processing, delivery areas, estimated delivery times, shipping fees and related conditions are described in our Shipping Policy.

Delivery times are estimates unless we expressly provide a guaranteed delivery commitment in writing.

Delivery may be affected by factors outside our reasonable control, including:

  • Courier delays;
  • Incorrect or incomplete customer information;
  • Customer unavailability;
  • Customs or regulatory processing;
  • Severe weather;
  • Public emergencies;
  • Transport disruption; or
  • Other force-majeure events.

We remain responsible for fulfilling our delivery obligations in accordance with applicable law and our published Shipping Policy.

19. Delivery Inspection

Please inspect your order promptly after delivery.

If the package or product appears damaged, incomplete, incorrect or materially different from the order, contact us as soon as reasonably possible and preferably within 48 hours.

Prompt reporting helps us investigate courier damage, missing items and incorrect deliveries. A delay in reporting does not automatically remove any mandatory right available under applicable law.

We may request photographs, videos, packaging, delivery labels or other reasonable evidence to investigate a reported issue.

20. Risk of Loss and Ownership

For retail consumer orders arranged by us, the risk of loss or damage normally transfers to you when the product is delivered to you or to a person authorised by you to receive it.

If you independently appoint a carrier that was not offered or arranged by us, risk may transfer when the product is handed to that carrier, to the extent permitted by applicable law.

Ownership of a product transfers only after we have received full cleared payment for that product.

21. Returns and Refunds

Eligible retail customers may request a voluntary return within 14 calendar days from the date of delivery, subject to the conditions stated in our Return & Refund Policy.

The Return & Refund Policy explains:

  • Return eligibility;
  • How to request a return;
  • Product-condition requirements;
  • Return shipping responsibilities;
  • Non-returnable products;
  • Inspection procedures;
  • Refund processing; and
  • The treatment of damaged, defective or incorrect products.

The 14-day voluntary return period is separate from any product warranty and does not limit mandatory legal remedies relating to defective, unsafe, counterfeit, materially misdescribed or incorrectly supplied products.

22. Warranty and After-Sales Support

The warranty period applicable to a product will be stated on the product page, invoice, order confirmation or applicable written sales document.

Eligible refurbished or pre-owned mobile devices may be supplied with a limited warranty, generally up to 12 months where expressly advertised. Different products and accessories may have different warranty periods.

A warranty claim may be subject to inspection and diagnostic testing.

Unless required otherwise by applicable law or expressly included in a protection plan, warranty coverage does not normally include:

  • Accidental or impact damage;
  • Cracked or physically damaged displays;
  • Liquid or moisture damage;
  • Misuse, abuse or neglect;
  • Damage caused by incompatible chargers, accessories or software;
  • Unauthorised opening, modification or repair;
  • Removed, altered or unreadable serial numbers or IMEI numbers;
  • Lost or stolen products;
  • Normal cosmetic wear;
  • Normal battery degradation consistent with the product’s age and disclosed condition; or
  • Loss of data or software not supplied by us.

Warranty exclusions will not be applied to avoid responsibility for a defect, material misdescription or obligation that cannot legally be excluded.

23. Device Accounts, Activation Locks and Customer Data

Before returning a device for refund, repair, exchange or warranty service, you must:

  • Back up your personal data;
  • Remove SIM cards and eSIM profiles where applicable;
  • Sign out of Apple ID, Google, Samsung and other personal accounts;
  • Disable Find My iPhone, Find My Device and similar services;
  • Remove passcodes and activation locks; and
  • Erase personal information where reasonably possible.

Repair, replacement, testing or software restoration may result in data being deleted.

We do not guarantee data recovery and are not responsible for personal data that a customer fails to back up or remove, except where liability cannot legally be excluded.

We may be unable to process a return or repair while a device remains protected by an account, passcode, activation lock, mobile-device-management lock or similar security restriction.

24. Manufacturer and Trademark Independence

Brand names, product names, logos and trademarks displayed on our website belong to their respective owners and are used only to identify or describe compatible products.

Unless expressly stated otherwise, SEVENCELL DEVICES is an independent retailer and is not affiliated with, sponsored by, endorsed by or an authorised service provider of Apple, Samsung or any other original device manufacturer.

A refurbished product sold by us should not be understood as manufacturer-refurbished or manufacturer-certified unless the product page expressly states this.

25. Promotions, Discount Codes and Gift Cards

Promotions, discount codes, store credit and gift cards may be subject to additional terms displayed at the time they are offered.

Unless expressly stated otherwise:

  • Discount codes cannot be combined;
  • Only one discount may be used per order;
  • Discounts cannot be exchanged for cash;
  • Promotions apply only during their stated validity period;
  • Promotions may be limited by product, customer, quantity or location; and
  • Gift cards and store credit are non-refundable except where required by law.

We may withdraw or correct a promotion where it contains a material error or is being abused, provided that accepted customer orders and mandatory rights are handled lawfully.

26. Intellectual Property

The Services and their content, including our company name, SEVENCELL DEVICES branding, 7C branding, text, graphics, logos, images, videos, page layouts and original website materials, are owned by or licensed to us and are protected by applicable intellectual-property laws.

You may access and use our website for legitimate personal or business purchasing purposes.

Without our prior written permission, you must not:

  • Copy, reproduce, republish or commercially exploit our original content;
  • Use our branding in a misleading manner;
  • Claim affiliation with or endorsement by us;
  • Remove copyright, trademark or ownership notices;
  • Create a confusingly similar website or identity; or
  • Use our content for unlawful, fraudulent or deceptive purposes.

Nothing in these Terms transfers ownership of any intellectual-property right to you.

27. Customer Reviews and Feedback

If you submit a product review, photograph, comment, suggestion or other feedback, you confirm that:

  • You have the right to submit it;
  • It reflects your genuine experience or opinion;
  • It does not infringe another person’s rights;
  • It does not contain unlawful, abusive, defamatory or misleading content; and
  • Any incentive or compensation connected with the review has been disclosed.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, format, publish and display submitted feedback for operating, improving and promoting our Services.

We may moderate or remove content that violates these Terms or applicable law. We will not knowingly edit a review in a way that materially misrepresents the customer’s opinion.

28. Third-Party Services and Links

The Services may include third-party tools, applications, payment services, delivery services or links to external websites.

Third-party services may be governed by their own terms and privacy policies.

We do not control and are not responsible for independent third-party websites or services, except to the extent that applicable law makes us responsible for a service used to fulfil our obligations to you.

You should review the applicable third-party terms before using an external service or completing a transaction outside our website.

29. Relationship with Shopify

SEVENCELL DEVICES is powered by Shopify, which provides the ecommerce technology used to operate our online store.

Products purchased through our store are sold directly by SEVENCELL DEVICES and not by Shopify.

SEVENCELL DEVICES is responsible for:

  • Product listings;
  • Prices;
  • Order acceptance;
  • Delivery;
  • Returns;
  • Refunds;
  • Warranty support; and
  • Customer-service obligations.

Shopify is not the seller of the products displayed in our store and is not responsible for the performance of our sales contract with you.

30. Privacy

Personal information collected through the Services is processed in accordance with our Privacy Policy.

Because our store is hosted by Shopify, certain personal information may also be processed by Shopify and other service providers involved in:

  • Hosting the website;
  • Processing payments;
  • Preventing fraud;
  • Providing analytics;
  • Delivering orders; or
  • Supporting store operations.

31. Prohibited Uses

You must not use the Services:

  • For any unlawful, fraudulent or malicious purpose;
  • To violate another person’s intellectual-property, privacy or legal rights;

  • To transmit viruses, malware or harmful code;

32. Service Availability

We do not guarantee that the website will always be uninterrupted, error-free or available.

We may temporarily suspend or restrict parts of the Services for:

  • Maintenance;
  • Security updates;
  • Technical problems;
  • Platform outages;
  • Legal or regulatory requirements; or
  • Events outside our reasonable control.

Temporary website unavailability does not remove our obligations concerning orders already accepted.

33. Disclaimer of Warranties

Except for warranties expressly provided by us and rights that cannot legally be excluded, the website and its general informational content are provided on an “as available” basis.

We do not guarantee that:

  • The website will always be uninterrupted or error-free;
  • Every website error will be immediately corrected;
  • The Services will be compatible with every device or browser; or
  • General website content will be suitable for every individual purpose.

This section does not exclude any express product warranty, mandatory consumer guarantee, responsibility for material product misdescription or other obligation that cannot lawfully be excluded.

34. Limitation of Liability

To the fullest extent permitted by applicable law, we will not be liable for indirect, incidental or consequential losses that were not reasonably foreseeable when the relevant contract was formed.

For business or wholesale customers, we will not be liable for loss of profit, revenue, anticipated savings, business opportunity, goodwill or indirect commercial loss, except where such liability cannot legally be excluded.

For retail consumers, nothing in these Terms limits liability or remedies that cannot be limited under applicable consumer-protection law.

Nothing in these Terms excludes or limits liability for:

  • Fraud or fraudulent misrepresentation;
  • Wilful misconduct;
  • Death or personal injury caused by liability that cannot legally be excluded;
  • Supplying counterfeit or unsafe products;
  • Mandatory product-defect remedies; or
  • Any other matter for which exclusion or limitation is prohibited by law.

35. Customer Responsibility and Indemnity

You are responsible for losses reasonably caused by your unlawful use of the Services, your infringement of another party’s rights or your material breach of these Terms.

For business customers only, you agree to indemnify us against reasonable third-party claims, losses and costs arising directly from:

  • Your unlawful resale, export or marketing activity;
  • Your unauthorised use of our intellectual property;
  • False information supplied by you; or
  • Your material breach of separately agreed B2B obligations.

This section does not impose liability on a retail consumer where doing so would be unfair, disproportionate or prohibited by applicable law.

36. Force Majeure

We will not be responsible for delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, war, civil disturbance, government action, epidemic, pandemic, transport disruption, telecommunications failure, widespread system outage, labour disruption or customs delay.

Where such an event affects an accepted order, we will take reasonable steps to minimise the impact and communicate available options.

This section does not remove any refund, cancellation or other right that applies where an order ultimately cannot be fulfilled.

37. Suspension and Termination

We may suspend or terminate access to the Services where:

  • You materially breach these Terms;
  • You use the Services unlawfully or fraudulently;
  • Your conduct threatens website or customer security;
  • You repeatedly abuse return, payment or chargeback procedures; or
  • Suspension is required by law or a competent authority.

Termination does not affect rights or obligations that arose before termination, including payment, refund, warranty, intellectual-property and dispute-resolution obligations.

38. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue in effect.

39. No Waiver

If we do not immediately exercise a right under these Terms, this does not mean that we have waived that right.

A waiver is effective only where it is expressly confirmed by us in writing.

40. Entire Agreement

These Terms, together with the policies and sales documents incorporated into them, form the agreement between you and us concerning use of the Services and applicable retail orders.

For wholesale or B2B transactions, an accepted quotation, invoice, purchase agreement or separate written commercial agreement may supplement or replace parts of these Terms.

41. Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent, except where applicable law provides otherwise.

We may transfer our rights or obligations as part of a lawful business transfer, restructuring or sale, provided that this does not reduce any mandatory customer right.

42. Governing Law and Jurisdiction

These Terms and any non-contractual obligations arising from them are governed by the applicable federal laws of the United Arab Emirates and the laws applicable in the Emirate of Dubai.

Subject to any mandatory consumer right to approach another competent authority or court, disputes will be subject to the jurisdiction of the competent courts of Dubai, United Arab Emirates.

Before commencing formal proceedings, both parties are encouraged to attempt to resolve the matter through direct written communication.

43. Changes to These Terms

We may update these Terms to reflect changes in:

  • Our business operations;
  • Our products or Services;
  • Shopify or third-party systems;
  • Applicable law; or
  • Security and fraud-prevention requirements.

The latest version will be published on this page with an updated revision date.

Material changes will apply from the effective date stated in the updated Terms and will not remove rights that arose under an order accepted before that date, unless required by law.
